David was touring the old Western Auto building in downtown Kansas City, which was in the process of being converted to condominiums. As he was looking out a window, an old-fashioned cast-iron radiator became dislodged from the wall as a train rumbled by and the radiator tumbled onto Dave, knocking him to the floor. He suffered an injury to his knee which required surgery, then physical therapy. He made a good recovery, but his medical expenses were some $16,000.00.
A claim was made against the project developer, and after extensive negotiations an out of court settlement of approximately $100,000.00 was reached.
