Larry Eppinger was driving to work on 150 Hi-Way in Kansas City Mo. when a truck going the opposite direction on the 2-lane road suddenly swerved directly into his path. Larry was able to avoid hitting the truck by taking the ditch on his right, but he was then thrown back into on-coming traffic and hit two vehicles head-on. The truck driver then left the scene and was never found. Larry had severe back and shoulder injuries with some $80,000.00 in medical bills.
A local concrete company was tentatively identified as the owner of the truck. Cain and Cain filed suit against the company and against Hartford, Larry’s insurance company (Missouri uninsured motorist policies provide coverage when injury is caused by a “phantom” driver). After a week-long trial, the jury awarded just under $1 Million against Hartford, which promptly paid the award without appeal.
